The entire estate was left to Smith’s son Daniel, who died last year.

The probate proceeding to sort out Smith’s assets, debts and taxes will lead to the establishment of a trust with eight-month-old Dannielynn as its sole beneficiary, said Stern’s attorney Bruce S Ross.

Birkhead has also filed papers to ask a judge to appoint him as guardian of Dannielynn’s estate.

“As the child’s father and caregiver, (Birkhead) is in the best position to protect and safeguard the interests of his child as guardian of her estate, including her interests in the estate of her deceased mother,” the petition said.

According to the lawsuit, O’Quinn appeared on several national television shows in which he suggested Stern murdered Smith. During an interview in Fort Lauderdale, O’Quinn told Fox News Show’s Greta Van Susteren that Arthur believed Stern had murdered her daughter and that O’Quinn agreed with her. O’Quinn also suggested on MSNBC that Stern had ulterior motives for wanting to see Smith’s will days before Smith died.

“The public airwaves should never be used to promote personal agendas or vendettas,” Stern’s attorneys L. Lin Wood said in a statement issued Friday.

Opri has represented Birkhead in his fight to prove his paternity and ultimately get custody of Dannielynn. Howard K. Stern, Smith’s companion, maintains that he is the father and currently resides in the Bahamas with Dannielynn.

TMZ.com reported that Birkhead sent Opri an e-mail discharging her last Tuesday, but Opri told the entertainment show “Extra” that she “just had enough,” implying that Birkhead is working with Stern behind her back.
